Fiverr and the New York Yankee's Game Changer Official Contest Rules

Duration

  1. Start Date for Submissions: August 23, 2017.
  2. End Date for Submissions: September 8, 2017.
  3. Final winners will be announced on September 14, 2017

Fiverr

Fiverr International Ltd. (herein sometimes, "Fiverr", "we," "us" or "our").

Participation:

  1. Participation will be opened from Wednesday, August 23, 2017/8am (EST) to Friday, September 8, 2017/10pm (EST) to participants who are 18 years old or older, owners of small/medium sized business (SMB), located in the US. SMB's are considered businesses of less than 1,000 employees.
  2. Participation in the contest is free of charge and open to all SMBs located in the US. To enter the contest, you must fill out all fields in the application form and submit your video. In the application form you will be asked to fill in your name, email, business name, Fiverr username (if you have one) and other details as may be required.
  3. In your video, you need to tell us about yourself and your SMB. You need to explain why you have chosen the path of an entrepreneur and why you continue to pursue it. You also need to share your biggest entrepreneurial success and low point. Videos need to be under 30 seconds. There are no other creative guidelines for the video - You can get as creative as you want. We are looking for good entrepreneurial stories and well thought out videos.
  4. Only one entry/registration per business will be eligible to participate in the contest.
  5. Any content delivered to Fiverr in the scope of the contest (including the videos for all participants and the ads for winners) may not:
    (a) Contain any material that is defamatory, obscene, profane or offensive; (b) is not of a suitable artistic and technical quality; (c) contain any false, unsubstantiated or unwarranted claims for any product or services; (d) contain any false or misleading statement or representation or unauthenticated testimonial; (e) advertise any habit-forming drug, tobacco product, weapon, firearm or ammunition; (f) violate the rights of any person, entity, firm or corporation, including intellectual property rights and any copyright; (g) disparage or libel any competitor's products, or; (h) depict the consumption of alcoholic beverages in violation of applicable law. By participating in the contest, you hereby agree to indemnify and hold us harmless from and against any and all claims inconsistent with the foregoing.
  6. The contest is not open to employees, contractors, agents or representatives of Fiverr or of Fiverr's advertising, promotion and fulfillment agencies, and their immediate family members (mother, father, brother, sister, daughter, son or spouse, regardless of where they live).

The Contest

  1. Contest duration will be August 23, 2017 until September 8, 2017.
  2. Five contest winners will be chosen as follows:
    First, the top 15 videos will be selected by a vote, where 10% of the vote will be made up of how many votes each SMB receives on its submission page, and 90% of the vote will be determined by a panel of eight internal Fiverr judges (each judge will select his/her top 15 videos in priority order. Points will be allocated for each position). Second, two additional judges (not from the first panel) will then review the top 15 and choose their top five picks. Fiverr will elect the contest judges at its sole discretion.
  3. Contest winners will be announced by September 14, 2017.
  4. The Contest Celebration Event - On September 18, 2017, the Yankees and Fiverr will host an event at the Yankees Stadium's Club Suite to celebrate the contest (the "Event"). The five winners and five other selected participants will be invited to the event. The winners will be announced by a Yankees representative on the field as part of the pre-game content. Participation in the Event is a condition for receiving the contest prizes. Winners are responsible for getting themselves to the Event.
  5. We reserve the right to extend or change any deadline periods, and to deny any participation for any reason without notice or explanation. The winning SMBs and/or features in the video content cannot conflict with any exclusive partner of the New York Yankees.

Prizes

  1. The contest winners will receive:
    1. Four Delta SKY 360 Suite tickets to a Yankees game. The game will be chosen by Fiverr. Winners will be responsible for all travel arrangements necessary to arrive to the games. If they cannot arrive, winners can forfeit the tickets in exchange for an additional $500 in Fiverr credit. Winners must notify us within 48 hours of knowing their game times.
    2. An ad displayed in the Yankee Stadium at two separate games. The games will be chosen by Fiverr. The ads will be created by Fiverr Pro sellers.
    3. Tickets to the Event on September 18th, at Yankee Stadium. Each winner will receive two tickets to the Event (as defined above). Winners are responsible for getting themselves to the Event.
    4. $1,500 in Fiverr credit + an Account Manager and a Fiverr mentor.
  2. Prizes are solely as stated and must be accepted as awarded. Prizes may not be exchanged for cash value. All taxes, duties, fees or other expenses associated with the prize are the sole responsibility of the winner.
  3. To receive a prize, winners will be contacted by Fiverr email. Each winner agrees to complete, sign and return an affidavit of eligibility and liability/publicity release. A winner's prize will be forfeited upon the occurrence of any of the following: (i) the failure of winner to confirm acceptance of the prize and return any required documents within three (3) days of prize notification by us; or (ii) determination by us that winner is ineligible or otherwise not in compliance with these Terms and Conditions.

Limitation of Liability.

Fiverr and all respective officers, directors, employees, representatives and agents shall have no liability and shall be held harmless by participants for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prizes or participation in this contest.

Cancellation of the Contest - Changes of Terms

We reserve the right to cancel the contest and/or change the present terms and conditions should circumstances so require, at any time, without notice or obligation to justify our decision and we will not be held responsible for it.
